1) ORDERING
Spirit of Malts undertakes to accept orders placed via the internet under the terms of these conditions of sale and within the limits of available stocks.
In the event of a stock shortage, we will inform you of the supply times required to obtain the desired product or we will offer you a replacement product.
Orders will only be considered once payment has been received and will be confirmed by e-mail.
Spiritof Malts reserves the right to cancel any orders that do not comply with the terms of the contract or are dubious, as well as those from a customer with whom there is any dispute.
2) PRICES
The prices shown are in euros and include all taxes.
The prices shown are net and exclude delivery charges.
Spirit of Malts reserves the right to modify its prices and delivery charges at any time, however the products will be invoiced on the basis of the prices in force at the time the order is registered and subject to availability.
3) DELIVERY
Orders are dispatched within 3 to 8 working days following receipt of full payment for the order.
The customer acknowledges that parcels are sent via Bpost, Mondial Relay or DPD.
The parcel is sent to the Delivery Point indicated by the customer or to the address specified when the order was placed on the www.spiritofmalts.be website.
The recipient will be notified of the arrival of the parcel by email and/or SMS, depending on the information recorded by the customer.
The parcel is delivered on presentation of proof of identity and a digital signature on the Point Relais terminal. This signature, together with the reproduction, constitutes proof of delivery of the parcel and the parties acknowledge that this signature has the same legal value as a traditional signature on paper.
Parcels are available to the recipient for a period of 12 days. Parcels that have not been collected will be returned to the sender via the Drop-Off Point.
Collection from Spirit of Malts is also possible by appointment and must be specified when ordering.
Collection is only possible in the Ath region, Wallonia, BE.
In the event that the goods delivered are damaged, the buyer is obliged to refuse the goods or to accept them only subject to a written reservation on the carrier's delivery note, to be completed jointly by the customer and the carrier. Any complaint relating to the goods delivered must reach the seller within 5 days of the date of receipt. The complaint must be sent exclusively by registered letter to the registered office: SPIRIT OF MALTS Chemin Croix Vasseau,6, 7800 Lanquesaint and must be accompanied by a copy of the purchase invoice and the delivery note completed with the written reservation mentioned above. After this period, no further claims for apparent defects will be taken into consideration.
Please note that Spirit of Malts delivers to Belgium, France, Spain, Italy, Denmark, the Netherlands, Austria, Germany, Luxembourg, Portugal, Poland, Sweden, Finland, the Czech Republic, Slovakia, Hungary, Bulgaria and Greece.
4) PAYMENT
Goods purchased on www.spiritofmalts.be are payable in full at the time of ordering, by bank transfer to IBAN account BE13 3770 4579 3939 or via the PayPal link. Bancontact payments are also accepted for Belgian customers.
All goods remain our property until full payment has been received. Before this payment, the buyer cannot dispose of them in any way.
5) RIGHT OF WITHDRAWAL
In accordance with Article 47 of Book VI of the Labour Code (inserted by the Law of 21 December 2013), relating to Market Practices and Consumer Protection, the purchaser has the right to notify Spirit of Malts that he/she renounces the purchase, without penalty or indication of reason, within 14 calendar days.
If the right of withdrawal is exercised within the aforementioned period, only the price of the Product(s) purchased and the delivery costs will be reimbursed, the cost of returning the Product(s) remaining at the Buyer's expense.
Spirit of Malts undertakes to make this reimbursement within a period of 14 days from the date of notification of withdrawal by the Customer. The refund will be made using the same method of payment as at the time of purchase.
The goods must then be returned in their original condition and complete (packaging, accessories, instructions, etc.) in packaging identical to that used at the time of dispatch, thus enabling them to be remarketed in new condition, and accompanied by a copy of the purchase invoice for optimum management. Returns must be made within 14 days from the date of notification of withdrawal by the customer.
6) PROTECTION OF MINORS
In accordance with the laws in force in Belgium, the sale of alcohol to minors under the age of eighteen (18) is prohibited. The purchaser undertakes to be at least 18 years of age when placing an order on the www.spiritofmalts.be website.
7) DISPUTES
In the event of a dispute, the Tournais (BE) courts shall have sole jurisdiction.
