1) ORDERS
Spirit of Malts undertakes to accept orders placed online under the terms of these conditions of sale and within the limits of available stocks. In the event of a stock shortage, we will inform you of the supply times required to obtain the desired product or we will offer you a replacement product. Orders will only be taken into account after receipt of payment and will be confirmed by e-mail. Spirit of Malts reserves the right to cancel any order that does not comply with the terms of the contract or is doubtful, as well as that of a customer with whom there is any dispute.
2) PRICES The prices indicated are in euros and include all taxes. The prices indicated are net and exclude delivery costs. Spirit of Malts reserves the right to modify its prices and delivery costs at any time but the products will be invoiced on the basis of the rates in force at the time of registration of the order and subject to availability.
3) DELIVERY Orders are shipped within 3 to 8 working days from receipt of full payment for the order. The customer acknowledges that the packages are sent by Bpost, Mondial Relay or DPD. The package is sent to the delivery point indicated by the customer or to the address specified when ordering on the website www.spiritofmalts.be. The recipient will be notified of the arrival of the package by email and/or SMS, according to the information recorded by the customer. The delivery of the package is made upon presentation of an identity document and an electronic signature on the Point Relais terminal. This signature, as well as the reproduction, constitute proof of delivery of the package and the parties acknowledge that this signature has the same legal value as a traditional signature on paper. The packages are available to the recipient for a period of 12 days. Packages not collected will be returned to the sender via the drop-off point.
Collection from Spirit of Malts is also possible by appointment and must be specified when ordering. Collection is only possible in the Ath region, Wallonia, BE. If the delivered goods are damaged, the buyer is required to refuse the goods or to accept them only with a written reservation on the carrier's delivery note, to be completed jointly by the customer and the carrier. Any complaint relating to the delivered goods must reach the seller within 5 days of the date of receipt. The complaint must be sent exclusively by registered letter to the head office: SPIRIT OF MALTS Chemin Croix Vasseau,6, 7800 Lanquesaint and must be accompanied by a copy of the purchase invoice and the delivery note completed with the written reservations mentioned above. After this period, no complaint for apparent defect will be taken into consideration.
Please note that Spirit of Malts delivers to Belgium, France, Spain, Italy, Denmark, Netherlands, Austria, Germany, Luxembourg, Portugal, Poland, Sweden, Finland, Czech Republic, Slovakia, Hungary, Bulgaria and Greece.
4) PAYMENT
Goods purchased on www.spiritofmalts.be are payable in full upon ordering, by bank transfer to the IBAN account BE13 3770 4579 3939 or via the PayPal link. Payments by Bancontact are also accepted for Belgian customers. The goods remain our property until full payment. Before this payment, the buyer may not dispose of them in any way whatsoever.
5) RIGHT OF WITHDRAWA
In accordance with Article 47 of Book VI of the Belgian Labour Code (inserted by the law of 21 December 2013), relating to market practices and consumer protection, the buyer has the right to notify Spirit of Malts that he or she is withdrawing from the purchase, without penalty or giving any reason, within 14 calendar days. If the right of withdrawal is exercised within the aforementioned period, only the price of the Product(s) purchased and the delivery costs will be refunded, with the cost of returning the Product(s) remaining the responsibility of the Buyer. Spirit of Malts undertakes to make this refund within 14 days from the date of notification of withdrawal by the Customer. The refund will be made using the same means of payment as when purchasing. The goods must then be returned in their original condition and complete (packaging, accessories, instructions, etc.) in packaging identical to that used during shipping, thus allowing their remarketing in new condition, and accompanied by a copy of the purchase invoice for optimal management. Returns must be made within 14 days from the date of notification of withdrawal by the customer.
6) PROTECTION OF MINORS
In accordance with the laws in force in Belgium, the sale of alcohol to minors under the age of eighteen (18) is prohibited. The buyer undertakes to be at least 18 years old when placing an order on the website www.spiritofmalts.be.
7) DISPUTES
In the event of a dispute, the courts of Tournais (BE) shall have sole jurisdiction.
